TERMS OF USE FOR CUSTOMERS
These terms of use (the "Terms of Use") govern your use of our website www.eassyserve.com (the "Website") and our “eassyserve” application for mobile and other devices (the "App"). The Website and the App are jointly referred to as the "Platform". Please read these Terms of Use carefully before you use the services made available on the Platform. If you do not agree to these Terms of Use, you may not use the services on the Platform. These Terms of Use expressly supersede prior written agreements with you. Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms of Use for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms of Use in the event of a conflict with respect to the applicable Services. Eassy Innovative Services Private Limited (“EISPL”) may restrict you from accessing or using the Services, or any part of them, immediately, without notice, in circumstances where EISPL reasonably suspects that:
• You have, or are likely to, breach these Terms of Use; and/or
• You do not, or are likely not to, qualify, under applicable law or the standards and policies of EISPL its affiliates, to access and use the Services.
EISPL may terminate these Terms of Use or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof:
• immediately, where EISPL reasonably suspects that:
• you have, or are likely to, materially breach these Terms of Use; and/or
• you do not, or are likely not to, qualify, under applicable law or the standards and policies of EISPL and its affiliates, to access and use the Services; or
• on 30 days' written notice to you, where EISPL, acting reasonably, terminates these Terms of Use or any Services for any legitimate business, legal, or regulatory reason.
The Platform is owned and operated by EISPL, a private limited company incorporated under the Companies Act, 1956 and having its office at WeWork Chromium, JVLR, Andheri East, Mumbai 400 076, Maharashtra, India. When you access any sub-site, webpage, hyperlink (whether belonging to an ‘associate’ of EISPL or otherwise), through this website or app, then such sub-site may have its own terms and conditions of use which is specific to such sub-site, webpage or hyperlink. The sub-sites, webpage, hyperlink may contain such additional terms and conditions of use as may be set out in such sub-site, webpage, hyperlink.
EISPL, may add to, change or remove any part of these Terms of Use at any time, without notice for complying with legal and regulatory framework and for other legitimate business purposes. Any changes to these Terms of Use or any terms posted to this Platform apply as soon as they are posted. You shall re-visit the “Terms of Use” link from time to time to stay abreast of any changes that the Platform may introduce. Your use of the Platform following the date that amendments to the Terms of Use take effect will signify your assent to and acceptance of any revised Terms of Use. If you do not agree to abide by these or any future Terms of Use, please do not use or access the Platform.
For the purpose of these Terms of Use, wherever the context so requires, "you", “user”, or “User” shall mean any natural or legal person who shall transact on the Platform by providing registration data while registering on the Platform as a registered user using any computer systems. The terms "EISPL", "we", "us" or "our" shall mean Eassy Innovative Services Private Limited.
1. USE OF PLATFORM AND SERVICES
ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by EISPL’s Policies ((including but not limited to Privacy Policy available on ( https://eassyserve.com/privacy-and-policy ) as amended from time to time. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with EISPL and these Terms of Use including the policies constitute your binding obligations, with EISPL. The “Services” constitute the provision of a technology platform that enables you, a user of EISPL’s Platform to: (a) arrange and schedule services of independent third party service providers (“Service Provider Services / SPS”), who have an agreement with EISPL or its affiliates (“Service Providers”); and (b) facilitate payments to Service Providers for their SPS and issue receipts for those payments. The Services are made available solely for your personal non-commercial use unless EISPL has agreed with you otherwise in a separate agreement. You acknowledge that EISPL does not provide any of the Service Provider Services and that all such Service Provider Services are provided by Service Providers who are independent third party contractors who are not employed by EISPL or any of its affiliates. THE SERVICE PROVIDERS ARE SOLELY RESPONSIBLE FOR THE SERVICES THAT THEY PROVIDE TO YOU AND ANY LIABILITY ARISING FROM A SPS IS TO BE SOLELY DISCHARGED BY THE RELEVANT SERVICE PROVIDER.
2. ELIGIBILITY
Services of the Platform would be available to only select geographies in India at the sole discretion of EISPL. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minor, un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the Platform and shall not transact on or use the Platform. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may and willing to use or transact the Platform, such use or transaction may be made by your legal guardian or parents on the Platform. Provided that the Parent/s and/or legal guardian using and transacting the Platform on behalf of the minor is/are registered user/s and act in accordance with applicable law. EISPL reserves the right to terminate your account and/or membership and / or refuse to provide you with access to the Platform if it is brought to EISPL's notice or if it is discovered that you are under the age of 18 years.
3. YOUR ACCOUNT AND REGISTRATION OBLIGATIONS
3.1 If You use the Platform You shall be responsible for maintaining the confidentiality of your login ID and Password and You shall be responsible for all activities that occur under your login ID and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform.
3.2 All Users have to register and login for placing orders on the Platform. You have to keep your account and registration details correct and updated for communications related to your purchases from the Platform. By agreeing to the terms and conditions, You agree to receive promotional communication and newsletters upon registration. You can opt out either by unsubscribing in "My Account" or by contacting the customer service.
4. PRIVACY
Please review our Privacy Policy, which also governs your visit to the Platform. The personal information / data provided to us by you during the course of usage of the Platform will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations. If you object to your information being transferred or used, please do not use the Platform.
5. E-PLATFORM FOR COMMUNICATION
You agree, understand and acknowledge that our Platform that enables you to avail services listed thereon at the price indicated therein at any time from any available location. You further agree and acknowledge that EISPL is only a facilitator and is not and cannot be a party to or control in any manner your third party transactions with Service Providers on the Platform. The contract of providing a service on the Platform shall be a strictly bipartite contract between you and the Service Providers/sellers registered with the Platform.
6. ACCESS TO EISPL SERVICES
We will do our utmost to ensure that availability of our Platform will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet/wifi/mobile networks, this cannot be guaranteed. Also, your access to the Platform may also be occasionally suspended or restricted for repairs, maintenance, or the introduction of new facilities/features or services at any time with sufficient information. We will attempt to limit the frequency and duration of any such suspension or restriction.
7. PERMISSION & PLATFORM ACCESS
Subject to the compliance with the Terms of Use EISPL grants you a limited, non- exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Platform on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use. Any right not expressly granted herein are reserved by EISPL and EISPL’s licensors.
8. RESTRICTIONS
You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services or SPS; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services or SPS except as expressly permitted by EISPL; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Platform; or (vi) attempt to gain unauthorized access to or impair any aspect of the Platform or its related systems or networks..
9. YOUR CONDUCT
9.1 You must not use the Platform in any way that causes or is likely to cause infringement of EISPL’s rights. You understand that you, and not EISPL are responsible for all electronic communications and content sent from your e- device/s to us. You ensure to use the Platform for lawful purposes only.
9.2 You must not use the Platform to host, display, upload, modify, publish, transmit, update or share any information that:
(i) belongs to another person and to which the user does not have any right to;
(ii) which is grossly harmful, harassing, blasphemous; defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
(iii) harm minors in any way;
(iv) infringes any patent, trademark, copyright or other proprietary rights;
(v) violates any law for the time being in force;
(vi) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
(vii) impersonate another person;
(viii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
(ix) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation;
(x) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person
10. REVIEWS, COMMENTS, COMMUNICATIONS AND OTHER CONTENT
10.1 Users of this Platform may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content does not fall within the categories listed under paragraph 9 above. In the event a user uses a false e-mail address, impersonates any person or entity, or otherwise misleads as to the origin of any content then, EISPL reserves the right (but not the obligation) to remove, refuse, delete or edit any content that in the sole judgement of EISPL violates these Terms of Use and, or terminate the relevant user’s permission to access or use the Platform.
If you post contents or submit material, and unless we indicate otherwise, you grant:
(a) EISPL and its affiliates a non-exclusive, royalty-free, irrevocable, perpetual and fully sublicensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and
(b) EISPL and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose.
10.2 You agree that the rights you grant above are irrevocable during the entire period of protection of the intellectual property rights associated with such contents and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to EISPL including the execution of deeds and documents, at its request.
10.3 You represent and warrant that you own or otherwise control all of the rights to the content that you post or that you otherwise provide on or through the Platform; that, as at the date that the content or material is submitted to EISPL: (i) the content and material is accurate; (ii) use of the content and material you supply does not breach any applicable EISPL policies or guidelines and will not cause injury to any person or entity; You agree to indemnify EISPL and its affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties.
11. OWNERSHIP
All content included on the Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of EISPL its affiliates or its content suppliers. You agree to follow all instructions on the Platform limiting the way you may use the content. You may not systematically extract/ or re-utilise parts of the content of the Platform or utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of the Platform or create and/ or publish your own database that features substantial (e.g., prices and service listings) parts of the Platform. Any unauthorized use of the content on the Platform may violate copyright laws, trademark laws, the laws of privacy and publicity, civil and criminal statutes. The content and information on the Platform, as well as the infrastructure used to provide such content and information, are proprietary to us or our affiliates, business associates, and suppliers. You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Platform.
12. OBJECTIONABLE CLAIMS
12.1 EISPL lists numerous services for sale offered by Service Providers on its Platform and hosts many thousands of comments/ reviews. It is not possible for us to be aware of the contents of each Service Provider Service, or each comment or review that is displayed. Accordingly, EISPL operates on a "notice and takedown" basis., if you believe that any content on the Platform violates the provisions of paragraph
9 above you may notify EISPL immediately at the email address mentioned below (“Notice”). On receipt of such Notice, we will make all reasonable endeavours to remove such objectionable content complained about within a reasonable time.
12.2 Upon receipt of a Notice we may take necessary actions, including removing information, all of which are taken without any admission as to liability and without prejudice to any rights, remedies or defenses, all of which are expressly reserved. Furthermore, in submitting a Notice, you grant to EISPL the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, and display its content throughout the world in any media. This includes forwarding the Notice to the parties involved in the provision of the allegedly infringing content. You agree to indemnify EISPL for all claims brought by a third party against EISPL arising out of or in connection with the submission of a Notice.
Important Warning: giving false, misleading or inaccurate information in the Notice to EISPL may result in civil and/or criminal liability. You should contact a legal advisor should you have any questions.
13. CHARGES
EISPL may charge any fee for browsing and buying on the Platform. EISPL reserves the right to change its Fee Policy from time to time. In particular, EISPL may at its sole discretion introduce new services and modify some or all of the existing services offered on the Platform. In such an event EISPL reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Platform and such changes shall automatically become effective immediately after they are posted on the Platform. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to EISPL.
14. PRICING
All the purchase of Service Provider Services listed on the Platform will be sold at the price mentioned for each Service Provider Service unless otherwise specified. The prices mentioned at the time of booking will be the prices charged on the date of the delivery. Although prices of most of the Service Provider Services do not fluctuate on a daily basis, in case the prices are higher or lower on the date of use of the applicable Service Provider Service no additional charges will be collected or refunded as the case may be at the time of the delivery of the applicable Service Provider Service. While the price charged to customers will not change, there may be a variance between the order value and the final amount charged for the Service Provider Services.

16. PAYMENT
16.1 While availing any of the payment method/s available on the Platform, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
• Lack of authorization for any transaction/s, or
• Exceeding the present limit mutually agreed by You and your bank/s, or
• Any payment issues arising out of the transaction, or
• Decline of transaction for any other reason/s.
16.2 All payments made against the use of the Service Provider Services on the Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. The Platform will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Platform.
16.3 You understand, accept and agree that use of the Service Provider Services may result in charges to you for the Service Provider Services you receive from the Service Provider. After you have received the Service Provider Services, EISPL will facilitate your payment of the applicable charges on behalf of the Service Provider. The payment facility provided by EISPL is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery or payment gateway. Further, by providing the payment facility, EISPL is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price in relation to the Service Provider Service.
16.4 Please note that as a standard procedure, any refunds against the booking will be credited back to the same payment mode used by You to make the payment for the transaction.
17. DISCLAIMER
17.1 All or any transactions which you do with the Service Providers shall be at your own risk using your best and prudent judgment before entering into any transactions through the Platform. EISPL shall not be liable or responsible for any actions or inactions of the Service Providers nor any breach of conditions, representations or warranties by the Service Providers. EISPL hereby expressly disclaims any all responsibility and liability in this regard. EISPL shall not mediate or arbitrate any dispute or disagreement between you and the selected Service Provider.
17.2 The Service Provider Services are provided ‘as-is’ and ‘as available’. You acknowledge and understand that the Platform is merely a forum to link you and other users like you with relevant Service Providers. EISPL does not guarantee and further expressly disclaims any warranties or representations (expressed or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the SPS listed or displayed or transacted or the content (including service or pricing information and/or specifications) on the Platform and makes no representation, warrant or guarantee regarding the reliability timelines, quality, suitability or availability of the SPS or that the SPS will be uninterrupted or error free. While we have taken precautions to avoid inaccuracies in content, all content,
information (including the price of the SPS), SPS and related graphics are provided as is, without warranty of any kind. Service Provider listings are merely hosted on the Platform and are posted solely at the direction of Service Providers (customers cannot contact Service Provider directly unless they buy memberships). We do not implicitly or explicitly support or endorse the sale of the Service Provider Services on the Platform. At no time shall any right, title or interest in the Service Provider Services sold through or displayed on the Platform vest with EISPL nor shall EISPL have any obligations or liabilities in respect of any transactions on the Platform. You agree that the entire risk arising out of your use of the Platform and any service requested in connection therewith remains solely with you to the maximum extent permitted under applicable law including the relevant consumer legislation.
18. LIMITATION OF LIABILITY
18.1 IF YOU ARE ACQUIRING THE SERVICES AS A CONSUMER, EISPL'S LIABILITY FOR A FAILURE OF ANY SERVICE PROVIDER TO PROVIDE A SPS WHICH MEETS YOUR REQUIREMENTS IS LIMITED TO: FACILITATING THE SUPPLY OF THE RELEVANT SPS AGAIN AT NO ADDITIONAL COST OR REFUNDING THE PAYMENT MADE BY YOU, IN ACCORDANCE WITH CLAUSE 15 ABOVE (CANCELLATIONS & REFUNDS & RESCHEDULE).
18.2 EISPL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES OR SERVICE PROVIDER SERVICES. EISPL SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY SERVICE PROVIDER, EVEN IF EISPL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EISPL SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND EISPL’S REASONABLE CONTROL. IN NO EVENT SHALL EISPL’S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED THE APPLICABLE SERVICE FEE PAID BY THE USER.
18.3 EISPL’S SERVICES MAY BE USED BY YOU TO REQUEST AND SCHEDULE SERVICES WITH SERVICE PROVIDERS, BUT YOU AGREE THAT EISPL HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY SPS PROVIDED TO YOU BY SERVICE PROVIDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS OF USE.
18.4 EISPL WILL MAINTAIN A COMPLAINTS MANAGEMENT FRAMEWORK AND WILL MANAGE THIS FRAMEWORK ON BEHALF OF SERVICE PROVIDERS, IN A REASONABLE WAY AND IN ACCORDANCE WITH THE NON-EXCLUDABLE REQUIREMENTS OF THE RELEVANT CONSUMER LAW LEGISLATION.
18.5 NOTWITHSTANDING ANYTHING CONTAINED IN THESE TERMS OF USE, EISPL WILL NOT BE DEEMED TO BE IN DEFAULT OR BE RESPONSIBLE FOR DELAY
OR FAILURES IN PERFORMANCE RESULTING FROM ACTS BEYOND THE REASONABLE CONTROL OF EISPL. SUCH ACTS SHALL INCLUDE BUT NOT BE LIMITED TO ACTS OF GOD, RIOTS, ACTS OF WAR, EPIDEMICS, PANDEMICS, TRADE EMBARGOES, FIRE, TYPHOONS, EARTHQUAKES, OTHER NATURAL DISASTERS. ETC.
19. INDEMNITY
You agree to defend, indemnify and hold harmless EISPL, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including reasonable attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to EISPL or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under these Terms of Use or arising out of the your violation of any applicable laws. This clause shall survive the expiry or termination of the Terms of Use.
20. TERMINATION
These Terms of Use are effective unless and until terminated by either EISPL or if You wish to deregister/exit yourself from the Platform. EISPL may terminate these Terms of Use at any time and may do so immediately without notice, and accordingly deny you access to the Platform. Such termination will be without any liability to EISPL. Upon any termination of the Terms of Use by EISPL, you must promptly destroy all materials downloaded or otherwise obtained from the Platform, as well as all copies of such materials, whether made under these Terms of Use or otherwise. EISPL's right to any comments shall survive any termination of these Terms of Use. Any such termination of the Terms of Use shall not cancel your obligation to pay for the service already ordered from the Platform or affect any liability that may have arisen under these Terms of Use.
21. TEMPORARY SUSPENSION OF ACCOUNT

Parties other than EISPL may provide services, on the Platform. In addition, we may provide links to the apps of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant or
endorse the offerings of any of these businesses or individuals, or the content on their platform. ESIPL does not assume any responsibility or liability for the
actions, products, and content of any of these and any other third-parties. You
should carefully review their privacy statements and other conditions of use.
23. COMMUNICATIONS
When you visit the Platform you are communicating with us electronically. You will be required to provide a valid mobile number while placing a booking with us. We may communicate with you by e-mail, SMS, phone call, online chat, or by posting notices on the Platform or by any other mode of communication. For contractual purposes, you consent to receive communications, notifications, (including transactional, promotional and/or commercial messages), from us with respect to your use of our Platform and/or your order placed on our Platform.
24. WAIVER
If you breach any of these conditions then, no failure or delay by EISPL in exercising any right, power or remedy shall operate as a waiver thereof, nor shall any single or partial exercise of the same preclude any further exercise thereof or the exercise of any other right, power or remedy. Without limiting the foregoing, no waiver by EIPSL of any breach by You of any provision of these Terms of Use shall be deemed to be a waiver of any subsequent breach of that or any other provision of these Terms of Use.
25. GOVERNING LAW AND JURISDICTION
These conditions are governed by and construed in accordance with the laws of India. You agree, as we do, to submit to the exclusive jurisdiction of the courts at Mumbai.
26. GENERAL
If any provision of these Terms of Use is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms of Use but the legality, validity and enforceability of the other provisions in these Terms of Use shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms of Use. These Terms of Use, including any incorporated policies, constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter. Nothing in this clause limits your rights as a consumer that cannot be excluded under applicable law, including the relevant consumer protection legislation. In these Terms of Use, the words “including” and “include” mean “including, but not limited to”.
